Mandatory declaration of chemicals to the product register is set out in the Norwegian declaration regulation.
Where the regulation applies, companies that manufacture or import chemical products must submit a declaration detailing the substance or mixture to the Norwegian product register. The obligation also applies for biocides and explosives precursors.
This is a national regulation that applies in addition to the European regulations CLP and REACH, were you also find the obligations to submit information to the European Chemical Agency, Echa.
The obligation to declare lies with the Norwegian company but can be done by another company. If a foreign company do the declaration, identification of the Norwegian customer (typically the importer to Norway) must be given in the declaration.
If your Norwegian customer is doing the product declaration and your company do not wish to reveal the composition of a mixture to that customer due to confidentiality reasons, you may register the composition yourself without disclosure to the customer. In this case composition is registered by using the registration form for "product in product", PIP, in the electronic system for declaration of chemicals. When the registration is completed, you will receive a declaration number. This number is required by the Norwegian customers to refer to when carrying out registrations. There are no fees when submitting composition only.
Declaration
Mandatory declaration must be done before production, sale or use can start in Norway. All declarations must be kept up to date. Updated information must be submitted if your chemical product has a new classification or changes the composition.
Send information to the Poison Information Centre
Importers and downstream users of mixtures classified with health or physical danger must notify these to the Poison Information Center according to CLP article 45 and annex VIII.
The duty to declare chemicals to the Norwegian Product Register, as given in national regulation, is still valid in addition to the notification to Poison Centres.
Notifications must be done to Echa`s portal for Poison Notifications (the PCN-portal) when notifying to the Norwegian Poison Information Centre.
The data submitted are used by Poison Centers in Europe for emergency health response when accidents or inappropriate use occurs. The Norwegian Poison Center, Giftinformasjonen, have access to Each database of Poison Centre Notifications for the Norwegian marked.

The duty to notify mixtures classified as hazardous due to health or physical danger lays on the importer and downstream user (and distributor) and is described in article 45 of the CLP Regulation. Annex VIII to CLP set the details for what to be notified, how, and when.

The compliance date for the submission of the information following the requirements in CLP Annex VIII apply in a stepwise manner, according to the use type.
Companies placing mixtures on the market not notified already under national legislation must comply with Annex VIII from the following dates:
- Mixtures for consumer use and mixtures for use: from 1 January 2021.
- Mixtures for industrial use: from 1 January 2024.
- Mixtures already notified under national requirements, i.e. are registered in the Norwegian Product Register before the timelines above are covered by a transitional period until 1 January 2025. Except in cases where there is a need to provide updated information. A change in the mixture composition, product identifier or toxicological properties may trigger a need for update.
Annual report of quantities
Each year, within 15 March all companies must report the annual quantities they have sold to their Norwegian customer the previous year. The annual quantities must be reported in tons, in the application for declaration of chemicals.

Fees
The information in the Product Register provides the basis for the authorities' fee for monitoring hazardous chemicals. This is a monitoring fee, not a declaration fee.
For each chemical product, subject to the declaration duty, an annual fee must be paid, cf. the Declaration Regulations (not currently available in English) article 10-13. The Norwegian Environment Agency has been authorized to collect these fees. The fees cover enforcement activities to ensure that companies comply with Norwegian regulations relating to chemicals.
- If the substance or mixture is classified only with respect to fire, explosion or oxidation hazard, it will not be subject to a fee.
- There are no fees for chemicals registered/declared as "product in product".
Biocide products with annual fee
There is no chemical fee for the chemicals that are biocides and were you have already paid annual biocide fee according to the Regulation for biocidal products.
We aim to correct possible double billing before distributing the invoices, but mistakes may happen. Please let us know if you have already paid biocide fee for a chemical listed on the invoice for the chemical fee.
You must ensure that information about your company is registered correct.
The fees are adjusted annually according to the inflation.
From 1 January 2024 it will be 840 NOK per chemical up to 100 chemicals, and then 140 NOK for each chemical above. The maximum fee is 113 320 per company, regardless of the number of chemicals.
