Companies that produce or import substances and mixtures (chemicals) that are subject to the duty to declare chemicals must report to the Norwegian Environment Agency for registration in the Product Register.

In addition, many chemicals also need to be notified to Echa's portal for Poison Notification.

Mandatory declaration of chemicals to the product register is set out in the Norwegian declaration regulation.

Where the regulation applies, companies that manufacture or import chemical products must submit a declaration detailing the substance or mixture to the Norwegian product register. The obligation also applies for biocides and explosives precursors.

This is a national regulation that applies in addition to the European regulations CLP and REACH, were you also find the obligations to submit information to the European Chemical Agency, Echa.

The obligation to declare lies with the Norwegian company but can be done by another company. If a foreign company do the declaration, identification of the Norwegian customer (typically the importer to Norway) must be given in the declaration.

If your Norwegian customer is doing the product declaration and your company do not wish to reveal the composition of a mixture to that customer due to confidentiality reasons, you may register the composition yourself without disclosure to the customer. In this case composition is registered by using the registration form for "product in product", PIP, in the electronic system for declaration of chemicals. When the registration is completed, you will receive a declaration number. This number is required by the Norwegian customers to refer to when carrying out registrations. There are no fees when submitting composition only.

Send information to the Poison Information Centre

Importers and downstream users of mixtures classified with health or physical danger must notify these to the Poison Information Center according to CLP article 45 and annex VIII.

The duty to declare chemicals to the Norwegian Product Register, as given in national regulation, is still valid in addition to the notification to Poison Centres.

Notifications must be done to Echa`s portal for Poison Notifications (the PCN-portal) when notifying to the Norwegian Poison Information Centre.

The data submitted are used by Poison Centers in Europe for emergency health response when accidents or inappropriate use occurs. The Norwegian Poison Center, Giftinformasjonen, have access to Each database of Poison Centre Notifications for the Norwegian marked.

The duty to notify mixtures classified as hazardous due to health or physical danger lays on the importer and downstream user (and distributor) and is described in article 45 of the CLP Regulation. Annex VIII to CLP set the details for what to be notified, how, and when.

The compliance date for the submission of the information following the requirements in CLP Annex VIII apply in a stepwise manner, according to the use type.

Companies placing mixtures on the market not notified already under national legislation must comply with Annex VIII from the following dates:

  • Mixtures for consumer use and mixtures for use: from 1 January 2021.
  • Mixtures for industrial use: from 1 January 2024.
  • Mixtures already notified under national requirements, i.e. are registered in the Norwegian Product Register before the timelines above are covered by a transitional period until 1 January 2025. Except in cases where there is a need to provide updated information. A change in the mixture composition, product identifier or toxicological properties may trigger a need for update.

Annual report of quantities

Each year, within 15 March all companies must report the annual quantities they have sold to their Norwegian customer the previous year. The annual quantities must be reported in tons, in the application for declaration of chemicals.

  • Import in this context refers to import to Norway.
  • Export in this context refers to export from Norway.

Fees

The information in the Product Register provides the basis for the authorities' fee for monitoring hazardous chemicals. This is a monitoring fee, not a declaration fee.

For each chemical product, subject to the declaration duty, an annual fee must be paid, cf. the Declaration Regulations (not currently available in English) article 10-13. The Norwegian Environment Agency has been authorized to collect these fees. The fees cover enforcement activities to ensure that companies comply with Norwegian regulations relating to chemicals.

  • If the substance or mixture is classified only with respect to fire, explosion or oxidation hazard, it will not be subject to a fee.
  • There are no fees for chemicals registered/declared as "product in product".

Biocide products with annual fee

There is no chemical fee for the chemicals that are biocides and were you have already paid annual biocide fee according to the Regulation for biocidal products.

We aim to correct possible double billing before distributing the invoices, but mistakes may happen. Please let us know if you have already paid biocide fee for a chemical listed on the invoice for the chemical fee.

You must ensure that information about your company is registered correct.

The fees are adjusted annually according to the inflation.

From 1 January 2026 it will be 890 NOK per chemical up to 100 chemicals, and then 140 NOK for each chemical above. The maximum fee is 116 690 NOK per company, regardless of the number of chemicals.

The following chemical products need to be registered

Chemicals classified as hazardous according to article 3 in the CLP regulation that are produced (in Norway) or imported (to Norway) should be declared to the Product Register if the annual quantities are 100 kg or more.

Find out if you need to declare composition information only or a full declaration on behalf of your Norwegian customer.

For registration of composition information only the "product in product", PIP-form, should be used. Less information is needed, and no report of annual quantities and fees are required.

If you need to send a full declaration for the chemical on behalf of your customer, please use the product form. You must give the name and organization number of your Norwegian customer.

Biocidal products are used to fight unwanted organisms.

Obligation to notify and label

All biocidal products on the Norwegian market must be notified to the Product Register, however small the quantities are.

The obligation to notify is independent of the quantity sold and their classification. If the biocidal product requires a hazard label according to classification and labelling legislation and is manufactured and/or placed on the market in Norway in quantities of 100 kg or more per year, it must be fully declared to the Product Register.

Declaring biocidal products to the Product Register is a separate obligation (section 3), which comes in addition to applying for approval, and other obligations in the Norwegian Biocides Regulation.

Links

Chemicals that contain precursors for explosives must be declared to the Product Register. The duty to declare applies however small the quantities are and enters into force no later than when the enterprise starts to manufacture, sell, or place their product on the market in Norway. For further guidance, please refer to the Regulation on the handling of explosives precursors, sections 2 and 8.

Regulations in Norwegian

If you purchase a chemical in Norway and resell this under another label or commercial name, the chemical must be declared to the product register, this applies even if the chemical was already declared before the alterations.

When submitting/reporting annual quantities, this amount should be registered under "name changed".

Find out if you need to declare composition information only or a full declaration on behalf of your Norwegian customer.

Make sure that you have been granted access to the system and have the role notifier or access controller for the company or companies you represent.

Foreign businesses may access the product register through the Norwegian Environment Agency's online application system for declaration of chemicals. To access Chemical declaration to the Product Register (the 2022 version), you must create a user profile at "Min side" (My page).

The duty to declare chemicals lays on the Norwegian importer. But other companies (in Norway or within the EU/EEA/EFTA), may submit this information on behalf of the Norwegian party responsibility for complying with the declaration duty.

If you only need to register the composition, please use the form for product in product PIP declaration, and you only need to send information on the full composition directly to the Product Register, and give your declaration number to your Norwegian customer to use as reference in his product declaration.

It is important that we know where to send the invoice. There are no fees involved when only submitting composition/PIP. Reference for the invoice must be given to help identify the invoice, like a PO no a name or something else according to the requirements in your own company. Contact information must be given to someone we can contact if there are question.

Can you use group declaration?

For virtually identical chemicals in the same series and with the same labelling, information may be submitted together. This is so-called group declaration.

This primarily applies to paints and varnishes but may also apply to other product types.

The following guidelines will form the basis for assessing whether group registration can be approved:

  • Each product series must contain at least 5 chemicals.
  • The chemicals must have the same unambiguous main name.
  • The chemicals must have the same labelling to indicate health, environmental, fire and explosion hazards.
  • The chemicals must belong to the same product type.

All the components must be given together with their minimum to maximum weight%. The difference between the minimum and maximum weight should be less than 10%. If necessary, the series can be divided into smaller groups to fulfil this demand. (If it affects the classification the minimum weight% cannot be zero.)
